Suspension of entry or imposition of restrictions by President
Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate. Whenever the Attorney General finds that a commercial airline has failed to comply with regulations of the Attorney General relating to requirements of airlines for the detection of fraudulent documents used by passengers traveling to the United States (including the training of personnel in such detection), the Attorney General may suspend the entry of some or all aliens transported to the United States by such airline.
According to the Constitution, the US Congress the power to impeach ANY federal official, including a U.S. District Judge. Given that Trump’s executive order is based on legal precedent, prior actions by the Obama administration, standing law and the US Constitution, and the states filing the original suit will not be irreparably damaged and have no standing, Robart is clearly an activist judge legislating from the bench and should be removed.
Again, The House of Representatives has the authority to initiate impeachment of 9th U.S. Circuit Court of Appeals judges Richard R. Clifton, William Canby, and Michelle T. Friedland. In refusing the Department of Justice’s request to stay a restraining order that halted enforcement of Trump’s travel restrictions nationwide, these judges have exceeded their judicial authority, recklessly jeopardized the safety of Americans and delivered an unethical and intellectual dishonest judgment unbecoming of the judicial branch of the Federal government.
I can hear the outcry already. “You can’t just oust a judge because you don’t like the ruling!!” Correct. I would never support removing any judge for an unpopular ruling. However, Trump’s executive order on immigration is not at all unpopular. Polling shows most Americans support extreme vetting and a temporary ban on visas from these seven terrorist countries. This is an outright liberal snubbing of the law and the Constitution. For that, yes, a judge should be removed, especially if said ruling could put American lives at risk.
